Privacy Policy

 

PURPOSE

At Body and Soul Health and Fitness (“B+S"), we are committed to protecting the privacy and confidentiality of your personal information. This policy (the "Policy") applies to the personal information of B+S’s clients, employees, and other individuals that is collected, used or disclosed by B+S. This Policy was developed in compliance with the British Columbia Personal Information Protection Act ("PIPA"). This Policy outlines (i) the types of information that B+S collects, (ii) the purposes for this collection, (iii) how the confidentiality of personal information is protected, and (iv) how you can contact B+S if you wish to access your personal information, have questions about, or want to make changes to any personal information that B+S may possess.

PERSONAL INFORMATION

Personal information is information that can be used to identify and/or contact an individual, but does not include:

  • an individual’s business contact information, including the individual’s name, position or title, business telephone number, business address, business email and business fax number;
  • personal information about an individual that is publicly available information as designated under PIPA, such as information available from a public registry or in a telephone book;
  • aggregated information that cannot be associated with a specific individual; and
  • information about a company, association or another organization.

COLLECTION OF PERSONAL INFORMATION

Examples of types of personal information that B+S may collect about its clients, employees and other individuals include:

  • contact information (including name, home address, home email address, home phone and cell phone numbers);

  • date of birth;

  • occupation and professional associations if voluntarily provided by the client, employee or other individual;

  • emergency contact information if voluntarily provided by the client, employee or other individual

  • information about clients’ and potential clients’ fitness interests, fitness goals and general fitness state;

  • information about the frequency of clients’ visits to its facilities and about the specific equipment, programs and services that clients utilize;

  • information on client or other individual reservations and B+S events that clients, employees or other individuals attend;

  • credit card information and/or banking information for billing purposes; and

  • images of clients, employees or guests on B+S’s social media platforms.

USES OF PERSONAL INFORMATION

We will only collect personal information that is necessary to fulfill the following purposes:

  • to verify identity;

  • to enroll clients in a program;

  • to determine client eligibility for registration and for receiving B+S’s products and services;

  • to identify and understand the needs and preferences of B+S clients, in particular, to understand clients' fitness and other related needs and objectives and to assist clients in achieving them;

  • to contact clients who have filled out the “Contact us” page;

  • to inform clients of various matters relating to their registration and about B+S’s products and services, including activities, special events and opportunities that we believe may be of interest to you;

  • to deliver services;

  • to process client’s payments and to ensure that client’s accounts remain up-to-date;

  • to establish, manage, and if necessary, terminate employment relationships; and

  • to meet legal and regulatory requirements.

LIMITING COLLECTION, USE AND DISCLOSURE

B+S will limit the collection of personal information to that which is reasonably necessary for the purposes identified above. B+S will not use or disclose personal information for any purpose other than those for which it was collected (as identified above). Where an additional use or disclosure is necessary, B+S will notify the client prior to or at the time of the additional use or disclosure, unless such notice is not required or permitted by law. Personal information will only be disclosed within B+S on a need-to-know basis.

CONSENT

Except where required or permitted to do so without consent, B+S only collects personal information with clients’ consent. When you become a client of B+S, you consent to the use of clients’ personal information for the purposes listed above. In most cases, B+S relies on express consent. However, where the purpose of the collection of personal information is obvious on its face (such as use of a credit card to pay an account), B+S may rely on implied consent. In some cases, such as using personal information for marketing B+S’s services to the client, B+S will rely on opt-out consent (i.e. information will be provided unless the client advises B+S that they do not wish to receive it). B+S only collects personal information where it is necessary to provide the service that the client is seeking and that B+S has agreed to provide, or to establish, manage, or terminate an employment relationship. B+S does not use deceptive or misleading practices to obtain consent. B+S reserves the right to collect, use or disclose personal information in certain limited circumstances, without the clients’ knowledge and consent, where required or permitted by law. Examples of this include:

  • when a reasonable person would consider that it is clearly in the client’s interests and consent cannot be obtained in a timely way;

  • when personal information is available from a public source;

  • in order to create aggregate information in order to identify client needs, preferences and trends and to aid in the development of new services and products;

  • to contact next of kin or a friend of an injured, ill or deceased individual;

  • where the collection, use or disclosure of employee personal information is reasonable for the purposes of establishing, managing or terminating an employment relationship between B+S and the individual;

  • for employment purposes;

  • when another Act or regulation requires or allows for the collection of information without consent (i.e. collecting an employee’s social insurance number as required by the Income Tax Act to issue a T-4 slip);

  • where it is required, by law, to be disclosed to law enforcement and other government agencies;

  • where it is reasonable to expect that disclosure with consent would compromise an investigation or proceeding;

  • where disclosure is for the purpose of complying with a subpoena, warrant or order issued or made by a court; and

  • where disclosure is required or authorized by law.

You may refuse or withdraw your consent to the use and disclosure of personal information in connection with the services that you have requested at any time, subject to legal or contractual restrictions and reasonable notice. B+S will inform you of the implications of withdrawing consent. If you wish to withdraw your consent at any time, please contact us.

THIRD-PARTY DISCLOSURE

B+S is not in the business of selling client information to others. We contract with trusted companies to act on our behalf to fulfill certain functions. The names, addresses and telephone numbers of our clients may be transmitted to a third-party mailing service in order to inform you of products and services that we offer (or that we and our partners jointly offer) and that we believe may be of interest to you. B+S will take steps to ensure that such third parties adhere to this Policy with respect to the protection of your personal information. Except as set out in this policy, or as required by law, B+S will not sell or disclose any of your personal information to any other organization or transmit personal information to third parties without first obtaining your consent. B+S may, however, disclose personal information in the following cases:

  • to B+S’s legal counsel;

  • to a police force, if required by law;

  • to a person authorized by law or a collective agreement;

  • to a government agency that can oblige us to do so;

  • in emergency situations in which life, health or safety of an individual is in danger; or

  • to all other persons authorized by law.

RETENTION

B+S will only retain clients’ personal information as long as is necessary for the fulfillment of the purposes for which it was collected or as required by law. Personal information is stored in a secure facility until such time as it is no longer required, after which it is destroyed.

ACCURACY

B+S will make reasonable efforts to ensure that personal information is accurate, complete and current as required for the purposes for which it was collected. You may ask us to delete or correct information contained in your file. The request for correction must be made in writing and provide sufficient detail to identify the personal information and the correction being sought.

SAFEGUARDS

B+S utilizes reasonable security controls in order to protect against unauthorized access, use, alteration, duplication, destruction or disclosure of personal information. This protection applies in relation to information stored in both electronic and hard copy form and will vary depending on the sensitivity of the information. We protect your personal information using the following safeguards, as appropriate:

  • physical measures, such as locked drawers or filing cabinets;

  • organizational measures, such as restricting access to personal information to designated individuals on a “need-to-know” basis; and

  • computer security measures such as encryption and/or password protection.

Each of our employees is responsible for maintaining the confidentiality and security of all personal information to which they have access. Only authorized individuals, who need to have access to such information in order to perform their duties, will have access to such information. We keep our employees informed about our policies and procedures for protecting personal information. Where necessary, our employees are required to sign agreements to keep your personal information confidential.

ACCESS

Individuals have the right to request access to their personal information that is in the control of B+S. Upon request, in writing to B+S, B+S will inform a client of the existence, use and disclosure of their own personal information and the client will be given access to that information, to the extent permissible by law. A client may challenge the accuracy and completeness of the information and request that it be amended, as appropriate. B+S reserves the right to refuse to comply with all or part of a request where it is required to or permitted to refuse to do so by the provisions of PIPA or other applicable legislation.

CHANGES TO THE POLICY

B+S reserves the right to modify this Policy at any time without notice. The Policy distributed at any time or from time to time posted via its website at www.bodysoul.ca shall be deemed to be the policy then in effect.

ACCOUNTABILITY

Questions or concerns regarding privacy procedures or B+S’s compliance with applicable privacy legislation may be directed to us by emailing contact@bodysoul.ca or by calling 604-224-2639. If an individual is not satisfied with B+S’s response, he or she may contact the Office of the Information and Privacy Commissioner in his or her respective province.

 

Cancellations and Memberships

 

LATE CANCELLATIONS FOR BOOKED SESSIONS AND CLASSES

Failure to successfully communicate a request to cancel, a minimum of 23 hours prior to a scheduled appointment will result in the loss of said appointment. If there are no sessions on account to deduct from, a drop in rate will be charged. Cancel your appointment through your online account or email contact@bodysoul.ca.

MEMBERSHIP FREEZE AND CANCELLATIONS

1:1 PERSONAL TRAINING MEMBERSHIPS

  • All requests to freeze MUST go through Front Desk

  • Can freeze for up to 8 weeks without charge per year (year since the start of enrolment)

  • $25 fee for each additional freeze period of up to 4 weeks (so if a client freezes for

  • 16 weeks, then they pay $50 in fees)

  • Can cancel after 2 months. Once canceled, cannot re-enrol again until the anniversary of when the initial subscription was started

2:1 PERSONAL TRAINING MEMBERSHIPS

Terms and Conditions

Please take the time to read and understand the terms and conditions set out below (the “Terms and Conditions”) prior to booking a training session, making any purchase or participating in any of the services offered by Body and Soul Health and Fitness (“B+S”, “us”, “we” or “our”).

OUR CONTRACT

These Terms and Conditions govern your relationship with B+S, including, but not limited to, your use of B+S website www.bodysoul.ca (the “Website”), your purchase of B+S training sessions or other services offered by B+S, your rights to cancel your purchase of training sessions or other services, your registration for training sessions, your purchase of merchandise, your communication with B+S, and your use of and attendance at B+S’s facilities. By accessing the Website or booking a training session through the Momence App, the Website or directly through one of our staff, or purchasing or participating in any of the services offered by B+S, you are deemed to have agreed to these Terms and Conditions (which, in addition to the Assumption of Risks, Waiver and Release of Claims Agreement, constitutes the entire agreement between you and B+S) and your booking will be accepted by us on this basis.

WE RESERVE THE RIGHT TO MODIFY THESE TERMS AND CONDITIONS AT ANY TIME. SUCH MODIFIED TERMS AND CONDITIONS WILL BECOME EFFECTIVE UPON OUR POSTING SUCH TERMS AND CONDITIONS TO THE WEBSITE. YOUR CONTINUED USE OF THE WEBSITE AND/OR B+S’S SERVICES AFTER SUCH A MODIFICATION HAS BEEN POSTED SHALL BE DEEMED TO CONSTITUTE ACCEPTANCE BY YOU OF ANY SUCH MODIFIED TERMS AND CONDITIONS. IT IS YOUR OBLIGATION TO REVIEW THESE TERMS AND CONDITIONS AND TO BECOME AWARE OF ANY MODIFICATIONS.

These Terms and Conditions incorporate by reference our Privacy Policy (available for viewing on the Website), which we may also amend from time to time in the future.

MINORS POLICY

If you are under the age of majority in your home jurisdiction, you may only use the Website under the supervision of a parent or guardian, and you may only register for training sessions if your parent or guardian does so on your behalf. B+S does not accept online bookings or other purchases made by minors, and by visiting this Website and purchasing training sessions and generally participating in the services offered by B+S, you represent and warrant that that (i) you are either (A) 18 years of age or older, or (B) supervised by your parent or guardian, and that (ii) either (A) you, or (B) your supervising parent or guardian, as applicable, have the right, authority and capacity to agree to and abide by these Terms and Conditions; and (iii) you will use the Website in a manner consistent with any and all applicable laws and regulations.

APPROPRIATE BEHAVIOUR; TERMINATION OF SERVICES

Our training sessions are run by certified fitness professionals whose mandate is to ensure that all of our clients are provided with a safe, positive and rewarding experience. At all times, you shall behave in a respectful manner towards other individuals and staff while at our facilities, and comply with all verbal instructions given to you by our trainers, as well as stated and customary terms, posted safety signs and rules. If any of our trainers determine (in his or her sole discretion) that your behavior is causing or is likely to cause harm, distress, danger or annoyance to any other individuals (including, but not limited to, clients and staff) at our facilities, or damage to property, the trainer may direct you to leave our facilities immediately, and we reserve the right to terminate your training session immediately, with no right of refund. We may also elect to deny you future access to B+S’s facilities and the opportunity to participate in any future training sessions. You may be required to pay for loss and/or damage caused by your actions.

In addition to the above, we may, in our sole discretion, terminate or suspend your access to all or part of the Website or the services we offer at any time, with or without notice, for any reason, including, without limitation, breach of these Terms and Conditions. Without limiting the generality of the foregoing, any fraudulent, abusive, or otherwise illegal activity that may otherwise affect the enjoyment of the services offered by B+S may be grounds for termination of your access to all or part of the such services at our sole discretion, and you may be referred to appropriate law enforcement agencies. After your access to our services is terminated for any reason, all terms of these Terms and Conditions survive such termination, and continue in full force and effect, except for any terms that by their nature expire or are fully satisfied.

RESERVATIONS AND CHARGES

Your credit/debit card will be charged for your order when you buy training sessions or series of training sessions, and when you book your specific dates. We will not process charges that use an incorrect, expired, or over-the-limit credit card. We will try to contact you if this occurs. If you fail to pay any fees or charges when due, services or privileges may be suspended or terminated. You shall be responsible and liable for any fees, including legal fees and collection costs, that B+S may incur in its efforts to collect any unpaid balances from you.

CLIENT CANCELLATIONS

You must inform us of a cancellation of a previously booked training session online through Momence in order to be eligible for any refund. Cancellations by email or telephone will be treated on a case-by-case basis, in our sole discretion, subject to the below cancellation fees. A cancellation will only be effective when we receive written confirmation of the same. If you provide us with written notice of a cancellation in compliance with the timelines set out below, we will refund the entire purchase price of that particular session within a reasonable time period after we receive your notice of cancellation. You shall have the option to receive the refund either to the original method of payment or as a B+S credit.

The following cancellation fees apply to cancellations we receive in advance of booked training sessions:

Small Group Personal Training and Group Studio Classes

If we do not receive a notice of cancellation from you at least 23 hours prior to a booked training session, you will be charged the full price of that particular training session.

1:1 Personal Training / 2:1 Personal Training

If we do not receive a notice of cancellation from you at least 23 hours prior to a booked training session, you will be charged the full price of that particular training session.

Please note that if we do not receive a notice of cancellation, and you do not show up for a previously booked session, we will charge you the full fee for that training session. If you leave a training session for any reason after it has commenced and prior to its completion, we will not be obligated to provide any refunds.

CANCELLATION BY US

We reserve the right to cancel a training session for any reason. If we cancel your training session, you can transfer amounts paid to an alternate available training session or receive a full refund. We may cancel a training session at any time prior to commencement if, due to terrorism, natural disasters, political instability, epidemics/pandemics or other external events, it is not viable for us to carry out the scheduled training session or if we perceive there to be a risk of harm, in our sole discretion. In circumstances where the cancellation is due to external events outside of our reasonable control, such as during a pandemic or other issue that could reasonably detrimentally impact the health and safety of our clients and staff, you will receive a credit towards a future training session, however refunds will not be permitted.

AGE & HEALTH REQUIREMENTS

We try our best to cater our training sessions to the particular fitness and strength and other capabilities of each of our clients. Nonetheless, we remind you that training sessions at B+S can be physically demanding and clients must ensure that they are suitably fit and healthy to allow for full participation. You are required to complete the “PAR-Q and YOU” questionnaire prior to participating in our training sessions, and you represent and warrant to B+S that you have completed the questionnaire honestly and to the best of your knowledge. We are able to provide details on mandatory health requirements; however, we are not medical experts. It is your responsibility to ensure that you obtain proper and detailed medical advice prior to participating in any of our training sessions.

We will not be obligated to provide you with a refund if you are unable to complete a training session due to your health, fitness or other physical limitations.

PHOTOS, VIDEO AND MARKETING

You consent to us using images of you taken during training sessions for social media, advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes.

PRIVACY POLICY

Any personal information that we collect about you will be treated in accordance with our Privacy Policy (available for viewing on our Website).

THIRD PARTY LINKS AND WEBSITES

B+S has not reviewed all the sites linked to the Website, and is not responsible for the content or any off-site pages or other linked third party sites. Although a third party website and/or app may contain B+S logos, advertising or other content, please understand that it is independent from B+S, and that B+S has no control over the content of that website and/or app. Accessing third party websites and/or apps from the Website is at your own risk. These links do not imply endorsement of, sponsorship of, or affiliation with B+S.

INTELLECTUAL PROPERTY RIGHTS

All material available on the Website and all material and services provided by or through B+S, its affiliates, subsidiaries, employees, agents, licensors or other commercial partners including, but not limited to, software, all informational text, software documentation, design of and “look and feel”, layout, photographs, graphics, audio, video, messages, interactive and instant messaging, design and functions, files, documents, images, or other materials, whether publicly posted or privately transmitted, as well as all derivative works thereof (collectively, the “Materials”), are owned by us or our licensors or service providers, and are protected by copyright, trademark, trade secret and other intellectual property laws.

Subject to your compliance with these Terms and Conditions, B+S grants to you a non-transferable, non-sublicensable, non-exclusive, revocable right to access and use the Materials that we make available to you through the Website or otherwise for the limited purpose of accessing and using B+S’s services.

All of B+S’s trademarks, service marks, trade dress, trade names, brand names, logos and domain names, whether registered or unregistered, including all goodwill in connection therewith (the “Trademarks”), are owned by us. You may not use the Trademarks without our prior written consent.

If we, in our sole discretion and without notice, consider that there is an immediate security or operational risk to the services we offer, or any of our, your or a third party’s system, then B+S may immediately suspend access to or use of the services we offer. The suspension of use and access is not a breach of these Terms and Conditions. You acknowledge that the preservation of security, confidentiality and data is paramount. B+S has no liability to you for suspending the services it offers under this provision.

You agree that any ideas, suggestions, concepts, processes or techniques which you provide to us related to the services B+S offers, the Website or B+S or its business (“Feedback”) are and shall be B+S’s exclusive property without any compensation or other consideration payable to you by B+S, and you do so of your own free will and volition. We may or may not, in our sole discretion, use or incorporate the Feedback in whatever form or derivative we may decide into the Website, its software, our services, documentation, business or other products, or any future versions or derivatives of the foregoing. You hereby assign all rights on a worldwide basis in perpetuity to B+S in any Feedback and, as applicable, waive any moral rights.

For the purposes of these Terms and Conditions and the Privacy Policy, “personal information” is any information about an identifiable individual, as defined in our Privacy Policy.

B+S retains the right to use or share any Aggregated Data generated by anyone using our Website, including our users, for the purpose of enhancing and better providing the Services. “Aggregated Data” means data which does not contain personal information and which has been manipulated or combined to provide generalized, anonymous information.

B+S does not sell information about our customers to third parties.

SEVERABILITY

In the event that any term or condition contained in these Terms and Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.

APPLICABLE LAW

These Terms and Conditions and all disputes connected with or related to them, including but not limited to related claims in tort, equity or otherwise, shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of laws principles. Each of the parties irrevocably and unconditionally accepts and submits to the exclusive jurisdiction of the courts of the Province of British Columbia and the City of Vancouver for all disputes. You waive any objection based on venue or forum non conveniens with respect to any claim arising under these Terms and Conditions, whether now existing or hereafter arising and whether in contract, tort, equity or otherwise.

WAIVER OF JURY TRIAL AND CLASS ACTION RIGHTS

WITH RESPECT TO ANY DISPUTE ARISING OUT OF OR RELATED TO B+S WEBSITE, THE SERVICES OFFERED BY B+S, AND/OR THESE TERMS AND CONDITIONS: (I) YOU HEREBY EXPRESSLY GIVE UP YOUR RIGHT TO HAVE A TRIAL BY JURY; AND (II) YOU HEREBY EXPRESSLY GIVE UP YOUR RIGHT TO PARTICIPATE AS A MEMBER OF A CLASS OF CLAIMANTS IN ANY LAWSUIT INCLUDING BUT NOT LIMITED TO CLASS ACTION LAWSUITS INVOLVING ANY SUCH DISPUTE.
